When a Hawaii seller is not a resident of the state, the buyer must withhold a percentage of the sale price and remit it to the Department of Taxation under HARPTA, and if the seller is a foreign person, federal FIRPTA withholding applies as well. For the mainland owner selling a Kihei condo, those withholdings can be the largest deductions on the closing statement, and they are a surprise if nobody told them.
A seller net sheet on your site that asks two questions — is the seller a Hawaii resident, is the seller a U.S. person — and shows the estimated withholding alongside the conveyance tax and commission is the tool that makes a listing agent look prepared at the listing appointment. It is also the tool that makes the seller call your escrow office rather than the one the agent’s brokerage usually uses.

Two recording systems and four islands
Hawaii’s Bureau of Conveyances records under the Regular System, and the Land Court registers title under a Torrens-style system with its own certificates, transfer certificates and fees. Some parcels are in both. Buyers who have never seen a Land Court certificate ask about it, and a site that explains the difference in a paragraph earns trust that a generic FAQ cannot.
The islands are separate markets with separate search behavior. Oahu is the volume market and the one where Realtor relationships decide who gets the escrow. Maui, Hawaii Island and Kauai are second-home and relocation markets where a large share of the parties are off-island and search before they choose. Each island gets its own page, and the resort towns — Kihei, Wailea, Kona, Waikoloa, Princeville, Poipu — get theirs.

Hawaii title website questions
How does the Hawaii conveyance tax work?
It is graduated by price tier, with higher rates applied when the buyer will not qualify for a county homeowner exemption. Our calculator takes the price and the occupancy status and computes it; the seller customarily pays.
What is HARPTA?
The Hawaii Real Property Tax Act requires the buyer to withhold a percentage of the sale price when the seller is not a Hawaii resident, remitted to the state as an advance on the seller’s tax. Our seller net sheet estimates it alongside federal FIRPTA withholding for foreign sellers.
What is the difference between Land Court and Regular System recording?
The Regular System records documents at the Bureau of Conveyances; the Land Court registers title to certain parcels under a certificate system with its own procedures and fees. Our site explains both and the fee tables follow the applicable system.
How are title rates regulated in Hawaii?
Underwriters file their rates with the Hawaii Insurance Division. Premiums differ by underwriter, so the calculators are configured to yours.
Who pays for the owner's policy in Hawaii?
By custom the owner’s premium is split, with the seller paying the larger share, and the buyer pays the lender’s policy. The calculators default to the custom and can be changed.
